What Do We Do With Your Information?

We respect the privacy of our customers and website visitors and are committed to protecting it. In this Privacy Statement, we describe TestCaseLab’s privacy practices in relation to the use of our services.

Generally, you can browse the TestCaseLab website without providing us with any personal information. We use web analytics services to analyze the traffic on the website in order to understand the needs of our customers and visitors so that we can continuously improve our website for them. Web analytics services collect only anonymous, aggregated statistics.

When you purchase something from the service platform, as part of the buying and selling process, we collect the personal information you give us such as your name and email address. We use this data to perform the services requested and fulfill our obligations under applicable terms of use/service and for the use of the service platform.

When you browse the service platform, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. We process your data to analyze trends and to track your interactions with our service platform to the extent necessary for our legitimate interest in developing and improving our service platform.

If you fill out one of our Contact us web forms or request user support, we process your data to the extent necessary for our legitimate interest in fulfilling your requests and communicating with you.

For marketing purposes, we may send you emails about the service platform, new products, and other updates, track your activity on our service platform, and monitor your actions, clicks, and data you input on our service (except credit card data).

How do we store your data?

We securely store your data at the Linode data center. It is located in London, UK. The Central Office of Linode is located in the US, 249 Arch St., Philadelphia, PA, 19106.

Consent

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, register account, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no..

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at support@testcaselab.com

Disclosure

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

TestCaseLab or third parties collect website navigation information through cookies and web beacons. You can control cookies through your web browser.

We use a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use billing Information except for the sole purpose of credit card processing on TestCaseLab’s behalf. Stripe is located in the US, 354 Oyster Point Blvd South, San Francisco, CA, 94080.

Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.

Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. You are solely responsible for protecting your password, limiting access to your devices and signing out of the service platform after your sessions.

If you choose a direct payment gateway to complete your purchase, Stripe stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, and American Express.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Use of Cookies

We use commonly-used information-gathering tools, such as cookies and Web beacons, to collect information as you navigate the service platform. Cookies are text files placed on your computer to collect standard Internet log information and visitor behavior information. When you visit our service platform, we may collect information from you automatically through cookies or similar technology.We use these cookies or similar technologies to analyze trends, administer the service platform, track users’ movements around our service platform, and gather demographic information about our user base as a whole.

Strictly necessary cookies are essential for the proper functioning of our website.  Without these cookies, the website would not work properly.If you agreed to identify yourself to the service platform, we may place on your browser cookies containing an encrypted, unique identifier. These cookies allow us to uniquely identify you when you are logged into the service platform and to process your online transactions and requests. 

Performance and Analytics cookies allow us to remember the choices you have made in the past. These cookies enable you to optimize your use of the service platform after logging in. Their purpose is to collect information about how you use our service platform. We use third-party services to track and analyze the usage and volume of statistical information from our customers in order to provide better interaction and more relevant communication.

Usage Data

Age Of Consent

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We do not provide the information to attract children. This means we do not knowingly solicit personal information from children under the age of 16.

Your Rights Under GDPR

If you are located in Europe or in the UK, we are committed to facilitating the exercise of your privacy rights under the EU General Data Protection Regulation and any applicable UK data protection regulation.

Retention Periods and Deletion

We retain your personal information to the extent necessary to reasonably serve customer relations, comply with legal obligations, enhance security and prevent fraud, and for auditing purposes. We retain your information during the time in which you have an account to use our service platform and for a reasonable period of time afterward. We will keep your personal data for 6 months of inactivity. Once this time period has expired, we will delete your data.

When you decide to delete certain information from your account, we will satisfy your request and delete this information from the service platform. We will also notify third parties that we authorized the use and share the content of your request.

Third-Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. We do not sell, rent or trade email addresses with other companies for marketing purposes.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our service platform website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

To facilitate the work of TestCaseLab, we may transfer and access your information outside the European Economic Area and make it accessible to the third party service providers internationally. We do so in order to provide you with our services.
Your Data may be collected, transferred to and stored by us in the United States. In this event, we will ensure that the recipient of your Data offers an adequate level of protection, for instance by entering into standard contractual clauses for the transfer of data as approved by the European Commission (Art. 46 GDPR) or by ensuring the recipient is self-certify under any regulatory acceptable mechanism. By visiting and using our service platform, you understand that your information will be transferred to those third parties with whom we share it.

Changes To This Privacy Policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. 

If our service platform is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
